Hong Kong Legislator Suggests Referencing China and Korea for AI Regulation
Need for AI Company Classification and Enhanced Regulation
Hong Kong Legislative Council member Kwok Pui-fan highlighted the potential risks of Artificial Intelligence (AI) technology, advocating for a tiered classification system for companies utilizing AI, based on their risk levels. She emphasized that enterprises employing AI in high-risk sectors such as healthcare, finance, and employment should be mandated to adhere to international standards like ISO or meet specific safety benchmarks and regulations to be permitted to use AI. For individual users, however, a self-regulation approach might be sufficient.
Referencing AI Regulatory Models from Mainland China and South Korea
Kwok suggested that Hong Kong should look to the regulatory frameworks of other regions, specifically mainland China and South Korea, when developing its own AI guidelines. She specifically cited mainland China's Interim Measures for the Management of Generative Artificial Intelligence Services, which mandates that all AI-generated content must be marked with an AI-generated watermark. This watermark should include not only visible indicators but also embedded information within the digital data to enable tracing the origin of the content. This measure is expected to be effective in preventing illegal activities and the creation of content with significant social impact using AI.
