Jury's Deliberations Highlight Credibility Issues
Josh Hadar, a juror in the Harvey Weinstein trial, noted significant contradictions in the witness testimonies. He observed that while the prosecution's witness displayed an incredible memory, the defense's witness seemed to forget many details. These discrepancies impacted the witness's credibility, making it difficult for the jury to reach a unanimous verdict of either guilty or not guilty. Hadar expressed disappointment that the jury could not deliver a verdict after their efforts.
Another juror, Sarae Perez, stated that the jury wanted to believe the victim's testimony but found it challenging to trust all aspects of the statements. She explained that there were moments where they couldn't fully trust the credibility of the testimony, which contributed to the deadlock. The jury's inability to be fully convinced by all evidence led to their lack of consensus.
Defense Attorney's Stance
Marc Agnifilo, Weinstein's defense attorney, expressed gratitude to the New York jury for their close examination of the evidence. He conveyed some disappointment that the verdict was not 12-0 in favor of the defense, but felt that they successfully raised sufficient questions about the prosecution's case. Agnifilo believed the jury paid close attention to their cross-examinations and summations, and considered the prosecution lucky to have swayed even three jurors. He asserted that there is no scenario where the prosecution would achieve a better outcome and urged the district attorney's office not to retry the case.
