The act was captured on security cameras, and Moreno-Gama has since been charged with attempted murder.

Brooke Jenkins, San Francisco District Attorney, confirmed that charges of attempted murder have been filed against Moreno-Gama. US Attorney Craig Missakian revealed that a search of Moreno-Gama's residence uncovered incendiary devices, kerosene, a lighter, and a document he authored. This document contained views opposing AI and AI executives, reflecting the author's intent to kill or attempt to kill the CEO. Court documents indicate that Moreno-Gama believed humanity faced an 'impending extinction' due to AI risks. He also reportedly went to OpenAI's headquarters and threatened to burn down the building. If convicted, he could face life in prison.
