Taliban Implements New Family Law 'Principles of Separation Between Spouses'
The Taliban has formally legalized child marriages in Afghanistan under a new family law governing marriage, divorce, and child marriage. Titled “Principles of Separation Between Spouses,” this 31-article regulation was approved by Taliban supreme leader Hibatullah Akhundzada and recently published in Afghanistan’s official gazette. The law outlines procedures related to marriage disputes, separation, guardianship, and annulments under Taliban rule. Human rights groups and the international community express deep concern that this legislation will severely undermine the rights of women and girls.

A particularly contentious provision states that the silence of a virgin girl after reaching puberty may be legally interpreted as consent for marriage. In contrast, silence from a boy or a previously married woman would not automatically qualify as consent. Additionally, complete authority over child marriages is granted to fathers and grandfathers, with annulment only possible if guardians are deemed abusive, mentally unfit, or morally corrupt. However, any annulment requires approval from a Taliban court. Many international observers, including humanitarian groups like Amnesty International, describe the Taliban regime's actions since seizing power in August 2021 as a gender apartheid system against women and girls.
