Enhanced Oversight and Risk Classification for AI Systems
Vietnam has introduced a new decree to strengthen supervision over artificial intelligence (AI) systems. This decree mandates that AI systems must be classified according to their risk level before being put into operation. It also establishes mechanisms for the evaluation, monitoring, and a national data portal for AI, emphasizing transparency and risk management. This initiative reflects Vietnam's effort to manage potential risks as AI applications expand across its economy and daily life, while also fostering innovation and technological market development.
Responsibilities of Providers and Implementers, and Principle of Non-Duplication
Decree No. 142/2026/ND-CP details the implementation of the AI Law, stipulating that providers must classify AI systems before their introduction. Implementers are required to review and reclassify systems in collaboration with providers if modifications or integrations lead to new risks. For high-risk AI systems, both providers and implementers must conduct conformity assessments. Test results from existing laws can be utilized to demonstrate compliance with specific risk management requirements for AI systems, ensuring the principle of non-duplication in classification, conformity assessment, and inspection processes.
